This is my 3rd day waiting on my background check to pick up my gun I purchased. The day I submitted my application there were over 2,600 people waiting. The next day 3,500. Today there are over 7,400 people! The NICS states that after 3 business days of being "delayed" and they haven't denied or approved you, it is an automatic approval. My question IS, does my situation count as being "delayed" because of the mass of applications? This is so frusterating. Anyone?

@smgangel: According to what I just looked up on google, you're right! If there's no response from NICS after 3 business days, federal law says the dealer MUST sell you the gun.

I wouldn't know. I only own shotguns and rifles. In GA you have to only do a background check and have a license to own a handgun.
