Equality Commission to take legal action over gay marriage cake


The Equality Commission in Northern Ireland has confirmed it is to take legal action against a Christian run bakery over the firm’s refusal to bake a cake promoting gay marriage.

Family-run Ashers Baking Company said it had refused to bake the cake ordered by a gay activist because it was at odds with its Christian beliefs.

The cake was to feature an image of Sesame Street puppets Bert and Ernie below the motto Support Gay Marriage.

Solicitors acting for the bakery maintained that their clients were not acting unlawfully.

The commission has said it is pursuing legal action as the case raises issues of public importance, regarding the extent to which suppliers of goods and services can refuse service on the grounds of sexual orientation, religious belief and political opinion.

A spokesman for the Equality Commission said: "In its letter the Commission stated that they would prefer not to have to litigate these issues and sought an acknowledgement that there has been an unlawful breach of the equality laws and an assurance that this will not be repeated.

It made clear that the claimant will be seeking only modest damages for the upset and inconvenience caused and that, failing this, a civil bill will be issued.

"The commission has now received a response from the company's solicitors stating that their view remains unchanged that their clients have not acted unlawfully, confirming they have no further proposals to make on their clients behalf and that they will accept service of a civil bill in regard to this matter.

"The Commission will be issuing a civil bill in this case and a decision as to whether or not discrimination has occurred will be a matter for the court."

@TheCelt: I personally dont care if it passes....two people wanna enter into a contract...so be it. Just curious what is gonna happen when a,say, Baptist preacher turns down doing a ceremony for a gay couple....

that's why Tennessee voted no lol....wait I just read some of that article...they okaying it?

The district TN is in upheld the ban on gay marriage. Because others districts did away with ban, theres now a discrepancy between federal discricts nationwide....Supreme Court will hafta step in and have the final say.

Hey, thats the best I can make of it lol...

And I think the Supreme Court will rule in favor of gay marriage.

Again, I have no issue with what two consenting adults agree into a contract with.....but again, as with the whole cake fiasco crap, what happens when a religious organization turns down a ceremony? Guess we'll see....

"" WASHINGTON -- The Supreme Court
agreed Friday to consider a major new
challenge to President Obama's health
care law.
The decision to hear the case without
waiting for a split among federal appeals
courts represents a major victory for
opponents, who had lost a unanimous
verdict at the U.S. Court of Appeals for
the 4th Circuit.
The justices agreed without comment to
reconsider that ruling, which upheld the
law's system of subsidizing the insurance
coverage it requires. That's a setback for
the administration and proponents of
Obamacare, but it is not the final word.
The controversial program faces four
separate lawsuits charging that billions of
dollars in subsidies can only be offered in
health care exchanges run by states. The
federal government operates more than
two-thirds of the exchanges.
Opponents mounted the challenges based
on the specific language of the law, which
states that subsidies, offered in the form
of tax credits, will be offered in exchanges
"established by the state." They contend
that nullifies the subsidies offered since
the program began in 36 states that did
not set up their own exchanges, relying
instead on the federal exchange -- a form
of online marketplace.
Any ultimate ruling against the system of
subsidies would blow a major hole in the
law. Those subsidies make the private
health insurance policies offered on the
exchanges affordable to most Americans
without employer-sponsored insurance
plans.
If the subsidies are invalidated in 36
states, then many of the tax penalties
imposed on employers and individuals for
non-compliance with the law also would
be eliminated. Employers pay a penalty
when their workers get subsidized on the
exchange. Individuals get penalized if they
don't buy affordable insurance, but the
subsidies often are what make it
affordable.
White House press secretary Josh Earnest
said officials still believe the law will be
upheld, just as it was in 2012, when Chief
Justice John Roberts wrote the court's
5-4 decision upholding the insurance
requirement as a form of taxation.
"This will work its way through the legal
process," Earnest said. "We continue to
have high confidence in the legal
argument, as a legal matter but also from
a common-sense perspective."
Other proponents of the law were not
nearly so sanguine. Ron Pollack, executive
director of the consumer health group
Families USA, said the court's willingness
to hear the case so soon "is a clear
indication that at least some of the
justices are determined to enter the
political fray about the Affordable Care
Act.""

Question to anyone opposed to gay marriage. Will you be changed in any way if my niece marries her fiancée? It's against my religion but that religion also teaches that only God can judge. I love that girl and if her female partner makes her happy so be it.

I have no problem with it either even though it's against my beliefs BUT my state NY just passed thru without a single vote by the people I thought that was illegal to pass a bill without the people's vote.
